Terms of Service
Welcome to ClearPath Finance. These Terms of Service (“Terms”) govern your access to and use of getclearpathfinance.com and any content, features, or services made available through it (the “Site”). Please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
The most important thing to understand
ClearPath Finance is an educational publisher, not a financial institution. We are not a bank, lender, broker, credit repair organization, tax preparer, immigration consultant, or licensed advisor of any kind. Nothing on this Site is financial, legal, tax, or immigration advice, and using this Site does not create an advisory, fiduciary, or client relationship of any kind.
1. Who may use the Site
You may use the Site only if you are at least 18 years old and legally able to enter into a binding agreement. By using the Site, you represent that you meet these requirements. The Site is intended for a general audience located in the United States; if you access it from elsewhere, you do so on your own initiative and are responsible for compliance with local law.
2. Educational purpose and no professional advice
All content on the Site — articles, guides, comparisons, examples, checklists, and any other materials — is provided for general informational and educational purposes only. It is written for a broad readership and does not account for your individual financial situation, immigration circumstances, tax position, or goals.
You should not act, or refrain from acting, on the basis of anything you read here. Before making any financial, legal, tax, or immigration decision, consult a qualified professional licensed in your jurisdiction — for example, a licensed financial advisor, an accredited nonprofit credit counselor, a certified tax professional, or a licensed immigration attorney. We do not endorse or recommend any specific product, institution, or provider, and any mention of one is illustrative rather than a recommendation.
3. Accuracy and currency of information
We make a reasonable effort to publish accurate information and to note when content was last reviewed. However, rules, rates, eligibility requirements, fees, government procedures, and institutional policies change frequently and differ by state and by institution. Content may become outdated, incomplete, or inaccurate at any time without notice.
The Site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. You are responsible for verifying any information directly with the relevant institution or government agency before relying on it.
4. Third-party links and content
The Site may link to third-party websites, tools, or resources. Those links are provided for convenience only. We do not control, endorse, or assume responsibility for any third-party site, its content, its products, its privacy practices, or its terms. Your dealings with any third party are solely between you and that third party.
5. Advertising and affiliate disclosure
The Site may display advertising served by third-party networks, including Google and its partners, and may participate in affiliate programs. This means we may earn compensation when you click certain links or take certain actions. Advertisements are selected by the advertising network and their presence does not constitute an endorsement by ClearPath Finance. Compensation does not influence our editorial content. Where required, disclosures appear on the relevant pages.
6. Intellectual property
Unless otherwise noted, all content on the Site — text, layout, graphics, and the ClearPath Finance name and marks — is owned by ClearPath Finance or its licensors and is protected by copyright and other intellectual property laws. You may read, download, and print content for your own personal, non-commercial use. You may not republish, redistribute, sell, or create derivative works from our content without prior written permission. You may quote brief excerpts with clear attribution and a link to the original page.
7. Acceptable use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to the Site, its servers, or any related systems.
- Interfere with or disrupt the Site’s operation, including by introducing malware or overloading our infrastructure.
- Scrape, harvest, or systematically extract content by automated means without our written permission.
- Misrepresent your identity or your affiliation with any person or organization when contacting us.
8. User submissions
If you send us a message, question, comment, or other submission, you grant us a non-exclusive, royalty-free right to use it for the purpose of responding to you and improving our content. Please do not send us sensitive personal information — such as your Social Security number, ITIN, account numbers, or identity documents — through the Site or by email. See our Privacy Policy for how we handle information.
9. Limitation of liability
To the fullest extent permitted by law, ClearPath Finance and its owners, operators, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, savings, data, or goodwill, arising out of or related to your use of, or inability to use, the Site or its content — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless ClearPath Finance and its owners, operators, and contributors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any right of a third party.
11. Changes to the Site and to these Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
12. Termination
We may restrict or terminate your access to the Site at any time, for any reason, without notice, including for conduct we believe violates these Terms or is harmful to other users or to us.
13. Governing law
ClearPath Finance is operated from Cuenca, Azuay Province, Ecuador. These Terms are governed by the laws of the Republic of Ecuador, without regard to its conflict of law principles. You agree that any dispute arising from these Terms or your use of the Site will be resolved exclusively in the competent courts of Cuenca, Azuay Province, Ecuador, and you consent to the jurisdiction of those courts.
14. Severability and entire agreement
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClearPath Finance regarding the Site. Our failure to enforce any provision is not a waiver of that provision.
15. Contact
Questions about these Terms can be sent through our contact page or to contacto@getclearpathfinance.com.
